Terms of Service

By signing up for the KDQ service (“Service”) you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Any new features or tools which are added to the current Service shall be also subject to the Terms of Service. You can review the current version of the Terms of Service at any time at https://www.kdquality.com/terms-of-service. KD Quality reserves the right to update and change the Terms of Service at any time without prior notice. In the event that any changes are made, the revised Terms of Service shall be posted on this website immediately.

Account terms

You acknowledge that KD Quality will use email address you provide as the primary method for communication.

You are responsible for keeping your password secure. KD Quality cannot and will not be liable for any loss or damage from your failure to maintain the security of your Account and password.

You are responsible for all activity and content such as data, graphics, photo and links that is uploaded under your website. You must not transmit and works or viruses or any code of a destructive nature.

A breach or violation or any term in the Terms of Service as determined in the sole discretion of KD Quality will result in an immediate termination of your services.

You agree to pay all applicable fee for Service in effect at the time of sign-up and/or renewal, subject to these Terms. You agree to update and keep current all of billing information, email and all other contact information. It is your responsibility to verify that the information submitted is accurate to insure proper billing and continuity of service.

Service fees and Billing

Fees for Services ordered by you shall begin on the initial order and will be billed in 30 day intervals (Billing Date). Any transaction Fees or Additional Fees will be charged to your credit card.

You must keep a valid credit card on file with us to pay for all of incurred and recurring Fees. KD Quality will charge applicable Fees to the credit card account that you authorize, and KD Quality will continue to charge the credit card or any replacement card for applicable Fees until the Services are terminated, and any and all outstanding Fees have been in full. All Fees and other charges are in U.S. dollars, and all payments shall be in U.S. currency.

New services or upgrades will result in additional fees/charges.

KD Quality does not provide refunds.

Limitation of Liability

You understand and agree that KD Quality shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.

In no event shall Shopify or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our service or these Terms of Service (however arising including negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, officers, directors agents, employees and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by third party due to or arising out of your breach of these Terms of Service or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

The Service is provided on an “as is” and “as available” basis without any warranty or condition, express. Your use of the Service is at your sole risk.

KD Quality does not warrant that the service will be uninterrupted, timely, secure or error-free.

Customer Content

You retain ownership over all Store Content that you upload to your website, you agree to allow others to view your Store Content. You are responsible for compliance of Store Content with any applicable laws or regulations.

We will not disclose your confidential information to third parties, except as required in the course.

KD Quality Rights

We reserve the right to modify or terminate the Service for any reason, without notice at any time.

We reserve the right to refuse service to anyone for any reason at any time.

You are responsible for the project’s progress as well. If we don’t receive any response from you within 10 business days without any notice in advance, we have the right to cancel the project (archive the project, it will cost $199.00 to re-activate and continue).

Cancelation & Upgrading

You may cancel your Service by emailing support@kdquality.com and then following the specific instructions indicated to you in KD Quality’s response. Cancellation is free after 1 year, no question asked; you will be charged for remain months for cancellation within 1 year.

There is no charge to upgrade to a higher plan, a $199.00 fee is applied for downgrading to lower plan. Upgrading / Downgrading is effective next billing cyle.

Without limiting any other remedies, KD Quality may suspend or terminal your Service if we suspect that you (by conviction, settlement, insurance or otherwise) have engaged in fraudulent activity in connection with your website.
